Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Bastion AI website and services. By using our services you agree to these Terms. If you use the services on behalf of an organization, you agree on its behalf and represent that you are authorized to do so.
Services
Bastion AI provides AI-driven security assessment, monitoring, remediation, and AI-enablement consulting as described on our website and in your order or statement of work.
Bring-your-own-key
You are responsible for your own AI provider accounts and API keys and for complying with each provider's terms. You retain ownership of your data and your model relationships. We use your keys only to deliver the services you engage us for.
Authorization to test
You represent and warrant that you are authorized to permit security discovery, testing, and remediation on the systems you ask us to assess, and that doing so does not violate any third-party rights or agreements.
Accounts
Some features require an account, which we secure with a passwordless email sign-in link. You are responsible for activity under your account and for keeping access to your email secure.
Payments and subscriptions
- Fees are billed in U.S. dollars through Stripe.
- One-time engagements are charged upfront. Subscriptions renew automatically each billing period until canceled.
- Monitor subscriptions are priced per billable identity (enabled users and active guests) in flat bands, metered from your tenant — not a seat count you pick.
- You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, payments are non-refundable.
- Taxes may apply and are your responsibility unless stated otherwise.
Acceptable use
You agree not to misuse the services, including by interfering with their operation, attempting unauthorized access, or using them to violate the law or the rights of others.
Intellectual property
We retain all rights in our services, software, and content. You retain all rights in your data and the materials you provide. We may use de-identified, aggregated data to operate and improve our services.
Disclaimers
The services are provided on an “as is” and “as available” basis without warranties of any kind, to the fullest extent permitted by law. Security reduces risk; it is not a guarantee against every incident.
Limitation of liability
To the fullest extent permitted by law, Bastion AI will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the services will not exceed the amount you paid us for the services giving rise to the claim in the 12 months before the claim.
Indemnification
You agree to indemnify and hold Bastion AI harmless from claims arising out of your misuse of the services or your breach of these Terms, including your representations regarding authorization to test.
Termination
You may stop using the services at any time. We may suspend or terminate access if you breach these Terms or to protect the services. Provisions that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and the state and federal courts located in Santa Clara County, California will have exclusive jurisdiction.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Continued use of the services after changes take effect constitutes acceptance.
